The implementation of foreign trade promotion programs has allowed Mexico to successfully enter the international market, since they promote the productivity, quality and competitiveness of companies. Although it is true that the legal entities that count with such programs have several benefits, they are also obliged to comply with several requirements, one of them being the presentation of the Annual Report of Foreign Trade Operations (RAOCE), which must be presented electronically, through the Mexican Foreign Trade Single Window (VUCEM).

  1. In accordance with the provisions of Article 25 of the Decree for the Promotion of the Maquiladora Manufacturing Industry and Export Services (IMMEX), companies that have the IMMEX program in any of its modalities, must submit the RAOCE, in accordance with the following:
  • Filing period, from April 1, 2022 through the last business day of May (May 31, 2022).
  • Failure to submit the RAOCE within the indicated period will result in the automatic suspension of the program.
  • Once the program has been suspended, the annual report may be submitted until the last business day of August (August 31, 2022), to the effect that the program has not been canceled.
  • The program will be automatically canceled on September 1, 2022 if the RAOCE is not submitted.

Considerations:

  • Foreign sales in excess of US$500,000, or its equivalent in local currency, or
  • Invoice exports for at least 10% of its total turnover.
  1. In accordance with the provisions of Article 8 of the Decree establishing various Sector Promotion Programs (PROSEC), companies that have the PROSEC program,
  • Filing period, from April 1, 2022 to April 29, 2022.
  • Failure to submit the RAOCE within the indicated period will result in the automatic suspension of the program.
  • Once the program has been suspended, the annual report may be submitted until the last business day of June (June 30, 2022), to the effect that the program has not been canceled.
  • The program will be automatically cancelled on July 1, 2022 if the RAOCE is not submitted.

2. Pursuant to the Fourth Transitory Provision of the Decree for the Promotion of the Maquiladora Manufacturing Industry and Export Services (IMMEX), published in the Official Gazette of the Federation (DOF), companies that maintain the Highly Exporting Companies (ALTEX) and Foreign Trade Companies (ECEX) program must file the RAOCE, in accordance with the following:

  • Filing period, from April 1, 2022 through the last business day of May (May 31, 2022).
  • Failure to submit the RAOCE within the specified period will result in automatic cancellation of the program on June 1, 2022.

Considerations:

  • EXEC Program:
  • ALTEX Direct Exporter Program:

The export percentage must be equal to or greater than 40% or total exports must be equal to or greater than US$2,000,000.

  • ALTEX:

The export percentage must be equal to or greater than 50%.

Likewise, it is important to point out the general considerations in order to correctly file the Annual Report on Foreign Trade Operations:

  1. The amount of total sales in thousands of pesos will be requested, in accordance with the information stated in the annual return.
  2. The total amount of exports in thousands of pesos will be requested, in accordance with the information provided in the annual declaration.
  3. Companies with an IMMEX Program, in order to determine their total sales, must have the value of their total invoicing (domestic sales and exports), as well as their total exports, the latter is calculated by adding the ratio of direct and indirect export documents.
  4. Companies that obtained their IMMEX Program in any of its modalities in 2022 are not required to file the annual report.
  5. Companies that work with goods on consignment, i.e., that do not own the inputs with which they produce the goods covered by this report, should only enter the added value of the goods (actual export invoicing).
  6. The data entered in the trade balance must be in thousands of pesos; it should be noted that the system will automatically convert them into dollars.
  7. If the companies no longer have any current promotion program, the annual report should not be submitted.
  8. The address of the legal entity must be “Located”.
  9. Once the Annual Foreign Trade Operations Report has been signed, it cannot be modified.
  10. In case the RAOCE has been submitted with any error, a clarification must be submitted to the competent authority within a period of no more than 5 business days.
  11. The total number of employees should be reported considering both administrative personnel and workers at the close of the last two semesters of the fiscal year being reported.

In this regard, it is vital to file the Annual Report on Foreign Trade Operations, since failure to do so could jeopardize the authorization of the aforementioned incentive programs.
